The legal system that originated in England and is now in use in the United States that relies on the articulation of legal principles in a historical succession of judicial decisions. Common law principles can be changed by legislation.
crimes
a violation of an existing societal rule or behavior as expressed in a criminal statute, for which a criminal punishment may be imposed.
customs
social rules of conduct or norms that do not not arouse the intensity of feelings that mores do; generally their violations will result in less severe reactions
felony
One of the highest class of offenses, and punishable with death or imprisonment.
folkways
social rules of conduct or norms that when violated carry the least intense feelings when compared to customs or mores.
infraction
the least serious violation of a criminal statute, normally punishable only by a fine. In many states traffic violations are considered infractions.
jail
a place of confinement for those awaiting trial and those who have been convicted of a misdemeanors.
misdemeanor
A crime that is punishable by fine and/or jail confinement
mores
social rules or conduct or norms that arouse intense feelings and are subject to extreme consequences when violated.
police power
The authority of a state to enact and enforce criminal statute.
procedural criminal law
That part of the criminal law that specifies the methods to be used in enforcing substantive criminal law.
stare decisis
The legal principle that binds courts to stand by prior decisions and use them as the standards to which to judge subsequent cases.
statutory law
Law created by legislative bodies to meet changing social conditions, customs, and public opinion.
substantial criminal law
The part of criminal law that establishes what conduct constitutes a crime and prescribes the punishment for violations of the crime.
